What's the appropriate way to adopt an 18 year old?

Hey, I hope everyone's doing alright. I have a question, regarding adoptions. I am wanting to adopt my stepson. He is 18 years old, and he agrees to it. Although, I am unsure of the best approach because I do not know if I could adopt an an 18 year old. If so, on what terms? Are there requirements? Certain eligibilities? What are all the options? Adult adoption is permitted in most states. If you both live in a state that does not permit adult adoption, one of you can relocate to a state that does to gain residency. You can then proceed with the adoption. Once final, you can move back. I believe an adult adoption is final the day the judge rules on it. I don't think you need a lawyer in any state that permits it since it is just filing paperwork and appearing before a judge.

For some of you posters: Adult adoption is often done when the now-adult child could not be adopted as a minor for whatever reason. Unlike just changing his name, it gives the adult child legal rights that he would not have without the adoption including being able to make medical decisions for his a-parents. Also, inheritance laws are stronger;

I know in wisconsin you can adopt at any age. Its not uncommon. You may have to get a lawyer though.

As to your question, Doodlestuff is absolutely right. Each state has different laws and proceedures. The best bet is to inquire at your local Probate Court or Clerk of Court's office. They can provide you with more specific information for your area.

hes 18....whats the diff if he is legally adopted?
if both of you consent, then stop calling him "stepson" and call him "son" i would surly hope that a piece of paper isnt going to stop you from doing that....

I think if the child has special needs you might be able to adopt at 18. I would call a lawyer, there may be a way.
I pray it works out for you and your daughter.

I don't think you can adopt an 18 year old - he would be classed as an adult.

What you can do is legally change his name so that he takes your surname.

This can be done by deed-poll (I'm talking UK but I guess the US has a similiar system - if you are from the States that is).

If its for some kind of benefit entitlements, I would be careful about being caught with that one, it would look very suspicious. States are being just as tough as Federal so, if thats your motive, I would reconsider. I know someone at work that tried it and they were fired and the insurance company took legal action.

You can't adopt a adult, he can change his last name to yours but I really don't think you can adopt him.

I don't think you can adopt an adult, they have to be under 18 I thought. He can change his name to your under his own authority. Call your courthouse or county clerks office to make sure though.
