What can I do if the birth father won't consent to giving up his rights so I can place our son for adoption?

I am an unwed mother of a one month old little boy. His father and I dated for a short time in North Carolina. When he found out I was pregnant, he left me. I moved home to Maine to be with my family. I chose to give the baby up for adoption. The birth father has had no contact with me throughout the pregnancy (his choice) and has provided no financial support. When he was contacted by the lawyer for the adoption agency, he is now refusing to consent to the adoption. I have told him that if he wants his son, he is welcome to come and get him, but three times he has said he was coming and never showed up. He has always had once excuse or another. I feel like I am being forced to raise a child I hadn't planned on keeping. I had a great adoptive family lined up, and my brother and his wife also have an interest in raising the baby. What can I do at this point?

It sounds like you need to find a Lawyer and set up a child support order for the baby and go after child support and whatever else can be collected for the birth of the baby.

There are also processes for each state to notify the father of his baby and give him the opportunity to exercise his parental rights or not before the baby is placed for adoption.

Well you can give leagal custody to your brother and sister in law because there is know custody agreement. They just can't legally adopt him. YOu are the primary custodian now though

Hopefully you don't have the adoptive family and your brother and his wife both sitting around waiting to know if they have your son or not. That would be very sad. I hate that adoption seems to hurt someone in these situations.

I agree that you could give custody to your family. Maybe the baby's father would agree to that.

I would try to get the courts to remove his rights since he has had no contact and provides no financial support. If you really are not able to care for the child I would consider placing him in foster care. Your brother and his wife could even go through the process and get approved to get him. That way if the courts did not remove his rights, he would have to meet many guidelines to get the baby. My nieces were placed in foster care and I got them out of a state home. There mom always said she wanted them back but would never do the things the court said she had to do. So in the end I have gotten custody of them. She does have some visitation rights bu rarely ever comes or calls. This is in Ga. but I would think all states have guidelines that have to be followed in order to get the child. You can ask the courts to remove his parental rights as he's had no contact and hasn't shown up to collect your son.

Your best bet is to get a lawyer, he has to establish paternity and in most states provide support in order to have parental rights. If he hasn't done those things his rights can be terminated and the baby can be placed for adoption without his consent. He has to basically put his money where his mouth is.

It may be possible to have the court rule something along the lines of "parents consent not required" because he has basically abandoned the baby and you.

You could do as many have suggested and sign custody to your relatives and let their adoption attorney take care of getting the termination or relinquishment or ruling from the court.

I am not sure what your state would require....but in many states it is possible to get a "consent not required" ruling...it takes longer though and will eat up money at the lawyer end.

North Carolina has a law called the putative father registry, which basically states that a father must sign with the clerk's office, and provide support for the child, both physically and financially, in order to maintain his rights. It does not relieve him of obligations if you do not place the child for adoption, he would still be liable for child support.

This law is designed to protect children from being in limbo forever. I just read a case law where the mother told the father she miscarried instead of giving birth, the child was placed for adoption, but even though he thought the mother lied, and found the baby, the baby still remained safely in his adoptive family. Many lawyers aren't aware of the putative father registry, and you might have to advertise in the last place of residence for the father.

Try to make arrangements one more time. Tell him if he doesn't provide support for this child within 48 hours, and comes and gets him, that you're placing him for adoption. No one can force you to be a parent. My prayers are with you, as there's no way for this to be a win-win situation, and the trauma he's putting you through is rough, but he's also had his chances, and he's choosing to not come get the baby.

why dont you allow your brother and his wife to raise the baby anyway they can look after him and them apply to become his guardian, they can do this without adopting him. It is not fair on them to keep them waiting around like this not knowing whether they are to raise your son or not.

Do the adoptive parents still want to adopt the baby even if he won't sign? Let them deal with him later on down the road. You can also take him to court and say he abandoned you. The courts will make him put up, of shut up. Good luck.

You can't do nothing. The father has the right to not give up his flesh and blood. You could take it to court to get a DNA test so he could start paying child support.

Also, depending on the laws where you live, the father might have to sign papers stating he agrees to give custody of whoever. After all, he's the father and has the same rights as you.

I would say he should be the one to raise his child but with the attitude he is displaying it might not be the best for the baby.

There are lots of parents out there who would give their right arm to have a child to raise and you could potentially change their lives.
We have been trying to have a baby for over a year now and I have just been diagnosed with suspected Endometriosis so it would be near impossible for me to conceive....it would be a great gift for anyone in a position like us.

I hope you get this figured out, remember the most important person involved in this is your baby.

Maybe the childs father contesting the adoption is a sign from GOD for you to keep your child.
