There is a lady who is picking up a brand new infant in jail. She has all rights, the biological mother was raped and never wishes to lay eyes on the baby, but wishes for it to be loved. Also she tried to commit suicide because of the baby and the State has removed her rights. This lady has all rights to the baby. She says once she gets back to town she'll call us and her friend is an attorney and will do the paperwork for free and the baby will be all ours. We've been TTC for 7 years and have always wished to adopt. We are very excited. But just aren't sure if there is more to do than this lady with the rights to the baby is saying???? This lady is dying of cancer and is in her late 60's. She cannot care for her she says. But the bio mom told whoever asked about who will take the baby that this woman will. The woman told her that she will, but she'll be finding her an adoptive home. Oh and the baby is in another state.....

Why would I go to jail for caring for the baby until all stuff is final?? Wouldn't that be like baby-sitting for the woman with the rights to the baby??

How does she have any rights to the baby. Only the biological parents have rights to the baby. Please make sure this is legal before you get your heart broken! Hire your own attorney! |

What connection does this older lady have, with the birth mom? The state is not going to allow this lady to just give you this baby, someone will have to follow a case plan and a caseworker will be checking on this baby until the adoption is complete.
Please be careful, this story seems odd to me. |

you have me lost with everything you are talking about here..... best thing to do is to get a lawyer and make sure it is handled accordingly.... do not count on her "attourney friend".... find your own credible attourney and handle it like that. |

This mystery lady does not have the legal right to place this child for adoption. The mother in jail has the right to pick you as the parents for the baby and terminate her rights for you to adopt. But in order for you to have the baby, the "lady", if she has gaurdianship, can transfer guardianship to you and you can petition the court to adopt. The mothers absence will count as abandonment but it will take a year or 2 to terminate her rights. If she is getting out soon she does, and should, have every right to her child unless the crime was child related. It is a long road but you can't just go adopting all willy-nilly like. :) |

No one picks up an infant in jail. The inmates who give birth are taken to either a public hospital or an infirmary to give birth, then the paperwork to place the child is done. The only way this could happen is if the 60 year old woman adopted the baby, then let you adopt from her. For your sake, I hope that everything is legal, but have your own attorney look at the papers. You must have a home study in place, and go before the court to adopt. If you take this child into your home, and then start the paperwork, you could be in jail yourself. There is a lot of paperwork for interstate adoption, and this sounds really fishy. Be careful!!!!! |
