What should happen to a adoption agency that continue to over look the fathers rights?

Don't say this don't happen because one adoption agency I know for a fact has 4 cases against them and they are still doing business in every state.
Have been caught in violation with the state DPS (just a slap on the hand)
Social worker for adoption agency found in violations for ethic in not informing the father ( still waiting for him to take his punshment after 2 years of delaying it.

I've been reading about what happened to your son's baby and I'm very sorry. It's an outrage and yes, something should be done.

Yes, his rights as a father are being overlooked. It's hard to get justice when you are up against the powerful adoption industry. Just ask adoptees and natural moms who have had their rights trampled on by them for decades. Corruption is rampant. Change is slow. Ethics often go out the window when they get in the way of big profits. That's all adoption is to them - it's a business. The baby is the product and the adoptive parents are the consumer. It's sad & pathetic, and I'm sorry I do not have a solution for you. Just know that there are many of us who understand and we care what your family is going through.

Agencies that "overlook" fathers rights should loose their license, or at least have it suspended for a minimum of 3 to 6 months. They should also be held liable for the legal expenses of the fathers who pursue their legal right to custody. Only when agencies are punished financially will they have an incentive to abide by the law.

It's ridiculous that agencies get away with violating laws that have been established to protect children's rights, their well being and the rights of their parents.

Edit: "overlook" should actually be "violated", because those agencies are violating fathers' rights!

Nothing happens to agency's that over look fathers. Fathers have the pesky potential to interfere with profits.

very little, usually the court will make the agency pay for any legal expenses of the father but not much in reality.

I am working on getting some of it fixed. If you have access to active federal cases: Brown v. State of Delaware, US District Court, District of Delaware. I am just a pro se filing but I am doing my best so that what happened to me won't happen to others.

What should happen to the: The people responsible should serve jail time and the company should pay restitution and legal fees.

That's illegal. It's a form of kidnapping. I hope they are being investigated.

The agency should be shut down and the persons involved in violating the father's rights should be imprisoned. Oh, and the child should be returned to the father.

Pipe dream. But maybe someday it'll happen.

The agencies should be shut down and criminal charges should be filed against the owners, lawyers, and "social workers" who continue to do this.

The most disgusting thing that the agencies do (in my opinion) is that when the courts order the adopted child returned to the father, they advise the adopters to keep custody of the child for as long as possible so that the adopters can try to gain public and court sympathy. The damage to the child is unspeakable.

Historically, the only way to beat big business is to file a class action suit. Can the 4 families join together, hire big gun lawyers, and start a legal defense fund? I am sure there are more fathers out there whose rights have been violated.

Adoption big business is especially vicious when fighting back because they have no way to diversify their product. A baby is a baby - their one and only product to sell. Available babies are scarce so the agencies are trying like crazy to bend and break the rules. I expect that we will see more of this violation of father's rights.

They should lose their license. Not all agencies do this though and not all responsibility falls on the agencies. My son's natural mother gave the adoption agency the wrong last name to my son's natural father. They terminated his rights only to find out later that he didn't even exist. Finally our son's natural mother realized it was in our son's best interest to have the correct father's rights terminated. So, about 1 month before we were supposed to formally adopt our son, we found out we had to reterminate his natural father's rights again. We went to hell and back trying to get his rights terminated. Finally after several months, we got the rights terminated. My agency did everything they could to locate and let my son's father know about him. They did eventually locate him and surprise surprise, he didn't care. I can happily say that my adoption agency makes it a priority to locate birth fathers, give them the opportunity to make a claim for the child, and if they choose not to, get the correct father's rights terminated.
