What would happen in this adoption situation?
|
This is hypothetical though I have always wondered.. If someone my age were to get pregnant (19) and she wanted to give the baby up for adoption but the father wanted to child, would the mother have to pay child support? What if both the people were underage like in the movie Juno? Or Too Young to be a Dad?

yep. the non-custodial parent is expected to pay child support, even the mother. some states allow child support orders for minors.
randy...my brother's wife ran off with an on-line dude, also. he was later arrested for ID theft. i mean, WTF??? |

My brothers wife walked out on him when their second child was about 1 year old. She wanted to live with some guy she met online.
Well, needless to say he has sole custody of the kids who visit with her 1 night a week (while he works late) and every second weekend. She wanted the kids for Halloween (which she considered at the time to be "her" holiday while she dabbled in Wicca) and he gets them for all other holidays. She's has been paying child support for the last 10 years and she was even responsible for half of their debt (he took over the mortgage though).
As others have said, whats good for one is good for the other. |

You betcha that mom would have to pay support if the father was raising the child. What's good for the goose is good for the gander!
If dad should anti up when he chooses to dump a child with it's mother then mama has to do the same. |

Yes, she would have to pay child support. That doesn't mean he will collect it however. Unless she had already signed papers giving up custody of the child (interrupted adoption) or would be considered unfit, she can continually threaten to take custody of the child should he seek child support. As a result, most men do not seek court assistance for child support.
I know 3 men who raised their child - 2 got custody after the child had already been adopted out,but were able to get their babies. None got child support even though it was court ordered. The kids are all college age now. Until courts support father's rights, if you are a guy, you will be stuck for all the costs unless you can prove the mother unfit. Otherwise, all she has to do is go to court and she will get custody, whether that is in the best interests of the child or not.
If she is underage, her parents are responsible for paying the child support if she doesn't. |

I would think that either the mother would give up her parental rights to get out of paying child support, or she would pay childsupport and keep her rights. Would just matter on the 2 parents involved. |

From what I know, the mother is not able to give a child up for adoption without the fathers consent. As far as the fathers rights, I do believe it all depends on the state laws, each state has different restrictions.
I would think that the father could ask for child support from the mother if she wanted to see the child and be involved. However, since she wanted an adoption, there may be a way for her to not pay child support....
The only way to know the "rules" for sure is to check the state laws, and the woman in question would need to consult with a lawyer, as this is a tricky situation. |
