When adopting a child is it necessary to disclose your HIV status?

The condition is under control. This relates to a lady in South Africa who desperately wants to adopt.
Additional Details
Those who say she will die are not educated about HIV. The doctors are certain she will live normally. Her viral load is almost undetectable now and she started early enough to have no complications.

Does any one actually know the law in this case?

Is HIV an issue? Must it be disclosed anyway?

No. We did not have any HIV tests when we adopted,

She can adopt: there is a huge need for adoptive parents for HIV+ orphans.

She will need a doctor to sign off on her having good health. With proper care, HIV is indeed manageble.

"Requirements for Special Needs or Medical Conditions: South African law does not require adoption agencies to disclose whether a child is HIV-positive. There is no legal requirement for prospective parents to be tested for HIV; however, adoption agencies may require HIV testing for the child, the natural mother and/or the adoptive parents before proceeding with a placement.

There is no legal requirement for a prospective parent to be tested for HIV.

Some agencies may require it.

Absolutely. An adopted child has already lost one set of parents, and should never be adopted by someone who has any type of disease that could be fatal. They shouldn't have to go through losing another parent.

Yes. No one wants their parents to have AIDS. When we adopted we had to take HIV tests.

Physicals by a doctor are required in the home study process (at least the the US) so the HIV would have to be disclosed.

Yes. This lady will die, at some point, because she has full blown AIDS which wont necessarily kill her but an illness such as pneumonia. A child will already have suffered loss of one set of parents so it will happen again.

Yes it would be required along with a complete health physical of both parents and all children of the couple.

In The States it would have to be but she's not in the states, so that doesnt matter.
Does ANYONE here know the adoption laws in South Africa? Im thinking they are probably different then in the US. Just a hunch. :giggle
