she has been with me since birth (she was born on dec 28th). I can't claim her as my daughter but can I still claim her as a dependent. I have her ss# and nobody else does so there won't be any double claiming of this child. I also have a doctors bill for the 30th to show that she was in my care.
the tax papers state that if someone lived with me all year that I can claim them to be in my household if they are related to me or not. it also states that a child that was born in the year is considered yours all year.
any help in this matter would be greatly appreciated

Yes you can claim her but until the adoption is legel you won't get every credit for her that your allowed when you claiming dependents.
You can claim anyone, sister, brother, parent, neice, nephew, fosterchild that has been placed in your care etc or even a friend but you will get the EIC and the Additional Child Tax Credit for her when the adoption is Final and Legal.
You will also be able to claim adoption fees so keep all receipts of transcations concerning this process.

The only requirement is that she has lived with you for at least 6 months - so for last years taxes 2009 - then no - but for 2010 - then yes even if she is still a ward of the state and the adoption is not final yet! |

yes, you can claim them as dependants on taxes. we did for years even before we had legal custody. |

Yes you can absolutely claim the child as a dependent. The board check you receive monthly is to Help off set the cost you incur with this child. It is not considered income. |

In some cases you can depending upon the context and the rules in your area. We are not able to claim our son as a dependent for tax purposes because his adoption is not yet finalized HOWEVER I am able to add him to my dental and medical plan because we have already signed the intention to adopt forms and it is in processing. |

Of course, I miss out because they move the kids around for various reasons. So, I have had two children in my home all year...but not the same 2 children. And because they were moved 3 times, no one gets to claim them.
But back to your question, you should be able to claim no problem. |

The US tax code allows for reasonable interpretations of the code and that seems quite reasonable if the facts are as stated. |

The laws for the state will vary. It was that if the child is a ward of th ecourt, and you are getting a subsidy for taking care of the child, as most foster placements (even family foster care) is then you cant claim the child as you are being compensated already. And if you do then claim the child, then you have to claim the income derived from the foster care. So since that subsidy is not taxable normally, its better to not claim the child. So talk to your and also look at how the subsidy would change your tax bracket if it will. Once you adopt the child you can claim them and then the subisdy, up to a limit, is not taxable.
