Applying for fiancee visa. My birth certificate doesnt match my current name i use. Will cause problems?

My birth cert. shows me as Holt. But my dad died wen i was young..mom remarried and i use my current name of DeWalt. i never legally changed my name. Wen i got passport..they made me use Holt but says 'see back' and shows alias can be used as DeWalt also. But with fiancee visa..must show birth certificate. Musti then use Holt in my paperwork?(my social security # is DeWalt too!

If you never legally changed your name then your legal name is “HOLT”, you have acquired a new name in which you are using now. It causes many problems to change name by “acquiring” and not “legally”. Since you are applying for a Fiancé visa, it would be best to apply under your “legal” name. Also, I’m assuming that you and your Fiancé will be adjusting status after marriage, so I would recommend marriage under the “legal” last name. If there is no rush to bring your fiancé here then you could go through the legal process of having your name changed and then you would have actual proof to give to USCIS. Also, you must take into mind that, your name change as an adult will bring up red flags for USCIS and your case will defiantly take longer (if you do not present a good application with good evidence), however you will not be denied on that aspect alone.

It really depends on if you are set on having your family and children carry your new last name or your “legal” last name. If you are set on keeping your current last name then go through the legal process before you apply for the Fiancé visa or get married. If you wait until after, it will be a greater task.

Since your passport shows both you should be ok. Many people use different names, as you have told them yours.

The Fruity Lady is correct: as long as you can reasonably explain the use of two names, they will not cause any problem.
