Depends...if he is in the U.S., have him apply for adjustment of status for green card. They will give him an option to obtain a work card at the time you file the paperwork.(anytime after you obtain a marriage certificate) If in the UK, get a fiancee visa for him (K visa) and he will have 90 days to marry you upon his arrival, then follow the above advice and adjust status. As you probably know, you have to petition for your husband to become a legal resident of the U.S. After all the paperwork is filed, and in the system, it will take them anywhere from 2-6 months to respond with what is called the "conditional" documents. These documents are all based on condition of the marriage. Depending on what papers you file, he can be granted the privileges of traveling outside of the country (because during the filing and petition for his residency, he will not be able to leave the country until he has those documents, because, technically his status will change), his Employment Authorisation Card will be sent to him, along with a few other documents. After that EAD card is received, he can then legally work in the States. HOWEVER, if he is here on a work visa, he can continue to work legally until those documents with the changed status arrive.

Once you marry him, and go to the INS/USCIS, they can tell you all the information that you need to know. If you want more reference, go www.uscis.gov - I know it seems like a lot that has to be done, particularly for a British citizen since we have such close immigration ties with EU countries, but in order for him to not have to continue renewing his visas in this country, that process must be completed before legal employment status can be accomplished.

Have you contacted the State Department in this matter or try the US Department of Labor. Once your boyfriend marries you he becomes an American citizen.

contact the us immg office he cannot work until he has the legal right to do so. it is not that easy. not like in the old days.
