Business Visa to the United States?
Find answers to your legal question.

Business Visa to the United States?

I was given a B1 (travel for business) Visa to the USA valid for six months only. My boss (has been a long time visitor to the states and has a 10 year tourist visa) and i plan to attend an expo in Dallas. There is an annotation at the bottom of my visa indicating that we plan to stay for 2 weeks only. The expo is only 3 days long, but we intend to stay for the full 2 weeks, would it be ok to say that we will visit some tourist spots (vegas etc) while we're here? Serious answers only please!

No problem, stay and enjoy your visit. Your sidetrips for pleasure are incidental to the purpose of your visit - the expo. Please note that the actual length of stay you are allowed will be determined by the CBP officer at the US port of entry, but will certainly be no less than two weeks. Have fun!

i just checked with the US immigration office :
B-1 Temporary visitor for business INA Section 101(a)(15)(B) 8 CFR 214.2(b)

B-2 Temporary visitor for pleasure INA Section 101(a)(15)(B) 8 CFR 214.2(b)
here is what the uscis says :
Business or Pleasure Visitors

Generally, a citizen of a foreign country who wishes to enter the United States must first obtain a visa, either a nonimmigrant visa for temporary stay or an immigrant visa for permanent residence. # The visitor visa is a nonimmigrant visa for persons desiring to enter the United States temporarily for business (B-1) or for pleasure or medical treatment #

(B-2). Persons planning to travel to the U.S. for a different purpose, such as students, temporary workers, crewmen, journalists, etc, must apply for a different visa in the appropriate category. Travelers from certain eligible countries may also be able to visit the U.S. without a visa, through the Visa Waiver Program. Read more about how to participate in the Visa Waiver Program on the U.S. Customs and Border Protection (CBP) website. More helpful information on the Visa Waiver program is found on the State Department Visa Services website.

B-1 visa, does not forbid you to visit while on business .........
please go check on the official page of the uscis official page if you would like ?

Technically NO, you cant stay for pleasure, your visa is intended only for business travel, with the way things are i would suggest u get a B1/B2 visa, which is valid for business and pleasure. Usually this visa is is issued jointly i.e. B1/B2, so the consular officer was not convinced that you should be given a visa for pleasure/holiday, if i were u i would simply go about my business and return and then apply for a visa again i.e. B1/B2. By the way at the port of arrival if you tell them that u are going to vegas to have a vacation, then the immigration officer at the port of entry may deny you entry and send you back by the next avlbl flight.

It sounds like you're doing more vacation than business. IF you're visa is a B1/B2, you're ok. If it's just travel for business, check with the consulate or US Immigration before you go. If you're boss' visa is just for tourism, he might need another visa (the B-1 travel for business) in order come to the US.

From what I can tell, B1 is for business and B2 is for tourism. I'm not sure you would be allowed to mix the two, especially since 9/11. Here is what I found on an immigration lawyer's website...

"Applicants should be aware that a visa does not guarantee entry into the United States. At the Port of Entry (POE), an Immigration Inspector must authorize the traveler's admission to the US. The inspector has authority to deny admission. Also, the inspector will determine how long the person is permitted to stay in the United States. If admitted, the inspector will issue the traveler a Form I-94, Record of Arrival/Departure, which notes the length of stay permitted. Those visitors who wish to stay beyond the time indicated on their Form I-94 must apply for an extension of stay with the US Citizenship and Immigration Services (USCIS) in the United States. The decision to grant or deny a request for extension of stay is made solely by the USCIS. "

My standard is honesty is the best policy. Tell them EXACTLY what you are planning to do. If you hedge and show any uncertainty, you could get into serious trouble. What's the worst that can happen if you tell the truth? You will be denied the full two weeks, but you will be allowed to go on your trip. What would happen if they think you are lying to them? I shudder to think.

I hope this helps, and enjoy your trip.
Blessings
