Can I alter my US visa?

I plan to study for my degree in the US and therefore must apply for a student visa. however, for this visa to be issued, I must prove that I plan to return to my home country, which I do not. Can I apply for a student visa and then change it, or would it be best to apply for a different kind of visa, and if so does anyone know which would be best?

Well, if you mean can you literally alter your visa, to change the information on it, the answer is probably yes, but it would be extremely hard to do without being obvious about it. A visa is more than the simple foil in your passport, it's all the information about you in the computer system, all of which is verified every time you use it. So, the first time you tried to use it, you'd get caught and sent back home and permanently barred from coming back. so, that's not such a good idea.

If you enter the US on a student visa and then want to change your visa status legally through USCIS, that could be possible and you wouldn't get locked up for trying it. However, you'd have to be qualified for whatever other status you want. If you intend to be a student, then you should apply for a student visa. If you intend to be something else, then you should apply for that type of visa, whatever that may be.

You are starting on the wrong foot. You have not yet even started and yet you are thinking of circumventing the rules. Get that student visa. Study hard and apply while you are studying. If you are that good, then maybe you will find an employer who will work for your H1B right after school. If not, you still have an advantage by having US education credentials. It is still a win-win for you.**

Apply for immigrant visa then. Get the "green card" and follow the laws. if you come to the US on a student visa and work, records will indicate that you worked, then you will not be let back in later on for about 7 years. Follow the laws and you will find that is the fastest route there.

If you do stay in the US you will be an illegal alien and unless your dream job is to work at a meat packing house or cleaning toilets, you will need paperwork to have any decent job, so bite the bullet and start now. The more time you spend doing things legally the mess back-pedaling you will need to do later on. Don't waste your time doing illegal stuff!

A condition of eligibility for a student visa is that you return home upon completion or termination of studies for a minimum of 2 years. As a non-immigrant class of visa, you are not eligible for any change of status to remain in the US. You would not be eligible for a work visa such as H1-b either, since that requires a minimum of 2 years of experience beyond the degree before an employer can hire you and apply for such as visa.

What you are trying to do is immigration fraud/visa fraud. It will get you jailed, deported and permanently barred from the US. If you want to immigrate to the US, you must apply for immigration and have a sponsor who is an immediate blood relative. You can get your university education in your own country while you wait for immigration approval.
