Can I have the British citizen if I am married to a British and have a baby born in England?

I am French citizen and have a baby born in England, I have been here for 6 years and my husband is british, can I also apply for a british passport?

You need to be a British citizen before applying for a British passport.

Because you lived in the UK for 6 years you should be eligible for Indefinate Leave to Remain (which you need to hold for at least a year) and then sit a Life in the UK test and attend an oath cermony and receive a British citizenship certificate. Then you will be British.


There are seven requirements you need to meet before you apply:

you are aged 18 or over; and
you are of sound mind; and
you can communicate in English, Welsh or Scottish Gaelic to an acceptable degree; and
you have sufficient knowledge of life in the United Kingdom; and
you are of good character; and
you are the husband, wife or civil partner of a British citizen; and
you meet the residential requirements; or
your husband, wife or civil partner is in Crown or designated service outside the United Kingdom.
Residential requirements

In order to demonstrate the residential requirements for naturalisation you need to:

have been resident in the United Kingdom for at least three years (this is known as the residential qualifying period); and
have been present in the United Kingdom three years before the date of your application; and
have not spent more than 270 days outside the United Kingdom during the three-year period; and
have not spend more than 90 days outside the United Kingdom in the last 12 months of the three-year period; and
have not been in breach of the immigration rules at any stage during the three-year period.

Applicants who are married to a British Citizen must:
Have been in the UK for 3 years and have ILR on the date of application.
Have been living in the UK at the start of those 3 years.
Not have been absent from the UK for more than 270 days in those 3 years.
Not have been absent from the UK for more than 90 days in 12 months before application.
Be of good character.
Pass the Life in the UK test.
Have sufficient knowledge of English, Welsh or Gaelic.
Have an intention to live in the UK.

the child will be an UK citizen by his father,
he can also have dual citizenship and so can you.
