an illegal immigrant who is in jail,on charges for marrying a us citizen inspite of being married and has kids in his home country,got arrested.
us american citizen and the illegal immigrant got a child in this marriage for citizenship..

can the deportation orders of this illegal immigrant who is in jail now get cancelled,if they apply for mercy on basis of this born child.what do u think can happen?WILL THE COURT ALLOW HIM TO STAY BACK IN US.

indian first wife is not yet divorced.
now the us american citizen threatens the indian wife ,n harasses her to divorce him,with the help of another illegal immigrant who is his brother..
how to get him deported?his brother also is illegal.
he and the american citizen wants to stop his deportation.
n if he is deported, she wants to come to india..n take him back...
can she do this..what can she do ..n what can i do here .please advise..

It has nothing to do with the American. This person violated INA laws and is subject to them. You can probably explain the situation at the deportation hearing but the INA laws doesn't give leeway.

and No if a person is deported they are typically banned for years and if you come back they can be banned for life from entering the US.

If he married a second time while still married to his first wife, this is polygamy, is a felony and second marriage void.

I am guessing the basis of being in jail/deported is the fact that they are illegals. It has nothing to do with marrying an american and having children. The child is american on the basis of having an american parent and possibly being born on US soil.

Anything else will be speculation as there may be other details that you have not mentioned.
