I need to travel to the US urgently next week. My L1 petition is approved, but I am yet to go for the interview. However, since this process takes atleast 10 days, my company cannot open that long, and they want to travel me first on B1 for 6 weeks, come back and take my L1 interview as soon as I return. I heard from a friend that if we travel to the US on B1, we should wait for a month atleast before we can apply for L1 interview, otherwise they will reject the L1. Is this true ? If yes, could you please direct me to the website/literature where this rule is mentioned so that I can convey the same to my company ? I would greatly appreciate if you could reply as soon as possible, as I have to travel in a week's time.

you wouldn't be allowed to work for your company on your B1. if you do, you will be violating your B1 status, and that will certainly cause problems if you're caught. there's no reason not to apply for your L1 as soon as the petition is approved. there's no reason to wait for 30 days after you return on a visit to the US. |
