Children with a dual nationality.....some help please.?

Hi,

How easy is it for my ex partner who is of a Algerian nationality to obtain a passport fo my children to get them to his country, he mentioned that one day he will take the children when I least expect it (so why he told me this makes me think its just to scare me but I am taking no chances). I understand that if he did do this, which I am on alert of already! if the children are in Algeria I have no rights to take them out of Algeria I wold need his permission to take them home, which he will never give me. I have since moved house with fear but as a clever as he can be, he has had my email password and knew everything about the move and turned up at my new house.

I am a firm believer children should never be denied access to either parent however he is making this very difficult for me, I can not trust him since saying this.

Yes you are right. You would have no rights in Algeria in regards to your children.
You need to get some sort of legal document to state clearly that you have cousity and that the children are not allowed out of the country with out your permission.
Get this in place soon
If any thing happens and he carrys out his threat ( which I dearly hope that never happens ), you have at least the backing of your country to fight for your kids.
You might need to get evidence that he intends to do this , record him saying so or if he has applyed for passports for the children lift the documents and give them to a solisitor.
Do this ASAP. and arm your self with knowledge on the rights you do have, so he cant scare monger you any more.

I am not sure about Algerian laws regarding getting passports for minors. If it is like the US, then he will need your permission to obtain those travel documents. International law forbids the transport of minors without a letter of consent from the other parent. So boarding a plane is also out of the question.

Since you seem to have custody over the children, having been able to move without his knowledge, then you could leave word in school that no one is allowed to pick up your kid except you. Not even their father. Also you can request a court to forbid him to come near the children without your presence or knowledge.

Change your email address and password. Do not use anything that your ex knows about you. For your peace of mind, try moving one more time if that is financially viable.

Get a court order granting you sole legal custody of your children (if you do not have one already). And move so he can't find you or your children. As difficult as it might be to uproot your lives, you don't want him to be able to kidnap your children.

And make sure you change all of your passwords, email addresses, etc. Do not sign up for sites like facebook where he can see where you are and what you are doing.

unfortunately he does not need your permission to get the children an Algerian passport, only the parent with the nationality can and may do so and without your knowledge,and if he does? and get the kids out? you as the mother will not be able to get them out.
only way is to hire someone to kidnap the children out of Algeria,and that? could be a huge hurdle..
you must change your email server,password and if you can afford it? move again without telling anyone,
have a restraining order against him,trust nobody but people you really know,

He sounds like a crazy. Change your e-mail and keep a close eye on the kids. Don't be afraid of him - it only gives him more power.

I think that he would need your permission to take them out of country in the first place.

It isn't hard to gain a passport for them if they have an algerian birth cetificate however it takes time for the passport to be obtained.

im sorry i couldn't help more but im afraid there are very few legal ways to deal with this
