Divorce Question?

If a woman is married to someone in the marines and wants to get divorced, they both agreed verbally over the phone to get divorced, she sent him all the proper paper work there are no children, no realestate, or any possesions that are disputed. he is on a base on the east coast and she is on the west. he has not signed or sent the paper work back, will not return phone calls or emails. the base chaplin was contacted and said to talk to legal aid, legal aid simply said they only defend people working in the military. poor credit and no money for an attorney. legally what could a woman that is stranded like that do?

Get a waiver? what the hell...I retired from the Army after 21 years and yes I have been divorced twice while in the service. There is no such thing as needing a waiver. The military will not assist you in filing for divorce or give consultations for divorce, counseling yes, but what you need to do is seek a civilian attorney, obviously you have already done this if you sent him the divorce papers, if he does not respond or show up to court, he would then default to the ideas of what is presented to the judge. and if you are married, then you should be recieving support from him, if not contact his unit commander, and that could help pay for the divorce lawyer, that could be found for under $1,000. 00. If he is stationed on the east coast, he is getting alot for BAH. Good luck.

There's no waiver of anything needed. Get yourself a civilian divorce attorney and file against him where you live. He does not need to be present or give any kind of consent.

Like the guy above me said, it sounds like you have already served him papers. If he won't sign them all you need to do is go to court and have the judge enter a judgment of divorce. You're not stranded.

When you get the final divorce order send a copy to his commanding officer. That way they'll cut off his housing allowance.

there is free legal aid in most citys. that is how I filed from mine, in my state which is CA. he how 30 day to respond, if not I win. Best the luck. Just know they are tons of people just like you fighting the same battle.
