I have been told that you may have a problem if you have a new passport

It depends were you live. The USA has a Visa waiver programme for people from certain countrys.

As long as your are in New york for less then 90days and are there for travelling/holiday only,not to work etc and you dont have a serious criminal record then you will be fine.
Id dont understand your question regarding the passport,if its new then you will be fine,all they ask is for a machine readable passport(they have to swipe the barcode) and seeing as yours is new then this wont be a problem

If you are visiting as a tourist from the UK for less than 90 days then no. You will be handed a 'visa waiver' form on the plane to complete before you land in the US.
