After me and my fiance marry, how long does it take to make it to where he can stay for good? he's coming for a visit for 3 months, so we are goin to marry then. Would he have to go back even though me marry, can we apply to get him to just stay, or do we have to have him go back over to scotland, and wait for the process?

Hottie, there are two proper ways to do it. One is by applying for a fiance visa (K-1) or for a spousal visa (K-3).
The first one is for you to sponsor him to come to the US with the intent of getting married. He will enter the US with a K-1 visa.
The second is if you both married outside the US and you have sponsored him to come live with you. He enters the US with a K-3 visa.
I strongly discourage you from marrying him if ever he enters the US on a B2/VWP. That will be a violation of his visa and/or the VWP.
I recommend using the fiance visa. That way when he comes, he will just adjust his status after the marriage. It takes about the same time for processing. |

Yes, I married a woman from Russia while I was working there for the State Department in 1997. It was over 13 months before she had her interview in Warsaw for her Immigration Visa [there are 2 ways to file]. The great thing was when she got this type of visa she was able to fly directly to the U.S. with no hassles whatsoever and automatically received her Green Card one month later [to the day it was a 30 day wait]. Now, if you go with the Fiance Visa process [he comes to the U.S. on the Fiance Visa issued by the embassy in his home country] then you'll have to read about it on the handy link I've provided from the U.S. State Dept. because since 9/11/01 a lot of these programs changed. Get a lawyer. I've seen this work out very badly before even when it is a real marriage. Contrary to common belief marriage does not guarantee a right to stay in the USA. |
