My mom is green card holder. she lives in canada. she came here form india by immigration visa and she stay here only 5 days and she went to canada and she came again after 5 months, and stays only 8 days and went back to canada. does she need to do re entry permit ? she might not stay their for more then 5 months from now. does she need re entry permit?

Best answer: "Probably."
The law requires physical presence once a year. She seems to have met that. However, since she seems to reside in 'Canada, she should hedge her bets by applying for a Re-Entry Permit, justifying her absence.
One presumes that she had an immediate relative in the USA to justify her I-551, so it seems reasonable that she may come to live with this relative. If so, then the Re-Entry Permit seems reasonable and necessary. |

Your mother has probably lost her LPR status in the United States by living in Canada the length of time she has. She has shown that she considers canada her home, not the United States.
