I am Australian and I came to the States to visit my boyfriend ... when I arrived he asked me to marry him YAY ... we are both very excited and want to get married while I am here in the States ... are we allowed to do this ... neither of us want us to be apart again as it has already been such a struggle ... can some one let me know what we can do?

Presumption of marriage fraud & visa fraud. Don't do it. You'll have to go home while he applies for your spousal visa and that could take up to 2 or 2-1/2 years.
Do it the right way from the start to save yourselves a lot of grief, time & money. Have him apply for a fiance visa as soon as you return home. He has to prove he has sufficient income and assets to support you and guarantee a $30,000 bond. You will be interviewed at the nearest US consulate in Australia. You both need to prove this is a "till death do us part" relationship. You should have your fiance visa within the year. Then you have 90 days from date of arrival to marry and file for the spousal visa. You will probably be allowed to remain in the US while that is processed. |

First of all CONGRATS!
Yes This is Technically allowed, but it must you must prove to the US Immigration that this was a spontanious, not planned at the time you entered. And a genuine marraige.This could be hard to prove at times considering one is not allowed to have immigrant intent under Visa Waiver Program, and it is a bit gray area if you have intent of marriage.
If you wish to save yourself time, money and headaches, don't get married yet.
Apply for a K1 visa in your home country and then enter on it. Anything less will cost your thousands of dollars more, take longer to process through US Immigration and cause more headaches then you can imagine as you may be accused later on that you used your Visa waiver status to Immigrate into the USA
