HOw can I find out if Argentine passports have been issued to U.S born Children in Argentina?

I am presently involved in a very contentious custody battle with my ex-wife, who is an Argentine National, which gives my children the "right" to Argentine citizenship.

There is currently no custody order.

She has threatened to abscond with them if I am awarded visitation.

I have been awarded temporary visitation until trial.

She has already fraudulently obtained U.S passports for them without my permission. And lied under oath about having possesion of passports for them. The judge now has said U.S passports

I have uncovered evidence of her hiding assetts (68,000 in Income from one client, unreported on financial affidavit required in custody cases) and two seperate Equity loans totaling 118,000. (one of them was on Jan 6 2006, 64,000 cash out, six days later she claimed "0" cash on hand in her sworn financial affidavit.

Everything about this stinks like a set up for international child abduction if she doesn't prevail in court.

Contact the Argentine Consulate in your area or the main embassy in Washington. If she has indeed obtained US passports fraudently-she has committed a federal offense-contact the US Passport office in Washington as well as Homeland Security. You are also able to place an alert on your children's passports which will alert any immigration official of a potential threat of international abduction. With that alert placed, both parents would have to appear before the US Customs officials (or any Custom official of any country!!) to verify that both parents were in aggreement of transportation of your children. Contact an attorney in your area that specializes in US Child Custody/Divorce cases as well as being licensed to practice law in Argentina!! My ex husband is Argentine, and we have an attorney that monitors my daughter's custody, etc both here in the US as well as Argentina. My custody (legal and physical) has been filed with the US courts as well as the national courts in Buenos Aires. Be very careful! Unlike so many other countries we hear about, Argentina is very pro-MOM! and your ex is an Argentine woman. There are agencies that assist US citizens in cases of international kidnapping: I'm sure they would also have information to assist you in preventing one as well. Best of luck! P.S. Check with the passport office about the signatures that were used to obtain the US passports for your children. If you didn't appear before the passport official, you would have had to send a notarized letter authorizing the application. If such a letter was sent, then the notary who authenticated your signature falsely is also committing local and federal offenses and needs to be prosecuted.

I am sorry to hear about your situation.

I would contact the consulate of Argentina in your town and find out if they have attorneys that could help you out with their laws. Maybe even let the consulate aware of the situation. Children of Argentine citizens do have the right to have citizenship of Argentina, but I am not sure how that works. However, in Argentina, exists what is called "patria potesta" which requires that any child traveling their with one parent must have the other parent's permission. I am a citizen of Argentina and my mother who was my custodian, because she and my father were never married, although my father gave me his name but was never around. My mother regardless needed his permission every time we went overseas until I was 21. This law was strictly enforced when I was a child more than 20 years ago. I do not know how much is enforced today. (I am 48)


I would recommend that you have more than one attorney if you can afford them. Whatever you do, please do not involve the children in this mess, and do make sure that your soon to be ex- wife does not involve the children in this mess either.

If I was a judge I might ask for an independent (a psychologist that the court knows, not yours or your wife's) psychological evaluation of the children and the parents. Your attorney can petition the judge to do this.

Both parents should reassure the children that they are loved and never talk bad about the other parent. This is really a big mess.

As a psychologist (I am one), I would recommend counseling for all of you. Some states (Texas does) have a course called "For Kids Sake" that is a course parents going through divorce must take. It is very helpful. God bless all of you. Good luck.

This is a serious matter and your attorney should be working on it. To get passports she'd have to go through the Argentinean embassy or an Argentinean consulate here in the US.

The Children's Passport Issuance Alert Program

The Children's Passport Issuance Alert Program (CPIAP) is a service for the parents and legal guardians of minor children. It enables the Department of State's Office of Children's Issues to notify a parent or court ordered legal guardian before issuing a U.S. passport for his or her child. The parent, legal guardian, legal representatives, or the court of competent jurisdiction must submit a written request for entry of a child's name into the program to the Office of Children's Issues.

Passport Issuance to Children under Age 14:
As of July 2, 2001, as provided by Public Law 106-113, Section 236, both parents are required to execute the passport application for a minor child under age 14. Please refer to our flyer U.S. Passport Applications for Children Under Age 14 for further information. If you believe that your child, no matter his or her age, may be abducted internationally, immediately contact the Office of Children's Issues and inform appropriate law enforcement officials. Information regarding the issuance of a passport to a minor is available to either parent, regardless of custody rights, as long as the requesting parents' rights have not been terminated.

The Department of State's Passport Namecheck Clearance System is a system to alert you when an application for a U.S. passport is made. In order for our office to notify an objecting parent, our office will need to have in our files the parent's request and a copy of a document such as a birth certificate or court order of guardianship that shows the relationship between the child and the objecting parent. This is not a system for tracking the use of a passport. Once a passport is issued, its use is not tracked or controlled by the Department of State. There are no exit controls for American citizens leaving the United States. This system can be used to inform a parent or a court when an application for a U.S. passport is executed on behalf of a child. The alert system generally remains in effect until each child turns 18. It is very important that parents keep us informed in writing of any changes to contact information and legal representation. Failure to notify this Office of a current address may result in a passport issuance for your child without your consent.

Passports - General Information:
A passport is a travel document issued by a competent authority showing the bearer's origin, identity, and nationality, if any, which is valid for the entry of the bearer into a foreign country. (8 U.S.C 1101(30)). Under U.S. law, U.S. citizens must enter and depart the U.S. with valid U.S. passports. (8 U.S.C. 1185(b)). This requirement is waived, however, for travel from countries within the Western Hemisphere, with the exception of Cuba. (22 CFR 53.2). However, each foreign country has its own entry requirements concerning citizenship, passports and visas. Information regarding those requirements may be obtained from the appropriate foreign embassy or consulate or from our publication "Foreign Entry Requirements." These requirements, along with the addresses and telephone numbers for the foreign embassies and or consulates near you are found on the Consular Affairs Internet web page at http://www.travel.state.gov under Foreign Entry Requirements .

The Privacy Act and Passports:
Please be aware that Passport Service records are subject to the Privacy Act of 1974 (5 USC 552a). The information contained therein, if any, is considered privileged and not a public record. If a file is located, it would be available only to the subject, his legal guardian, custodian or pursuant to a court order issued by a court of competent jurisdiction. Passport information is protected by the provisions of the Privacy Act (PL 93-579) passed by Congress in 1974. Information regarding adults may be available to law enforcement officials or pursuant to a court order issued by the court of competent jurisdiction in accordance with (22 CFR 51.27).

Dual Nationality for Children:
Many children, although born in the U.S. or born abroad to a U.S. citizen parent, are citizens of both the U.S. and another country. This may occur through the child's birth abroad, through a parent who was born outside the U.S., or a parent who has acquired a second nationality through naturalization in another country. A child may acquire another nationality without the consent of the U.S. citizen parent.

The inability to obtain a U.S. passport through the Children's Passport Issuance Alert Program does not automatically prevent a dual national child from obtaining and traveling on a foreign passport. There is no requirement that foreign embassies adhere to U.S. regulations regarding issuance and denial of their passports to U.S. citizen minors who have dual nationality. If there is a possibility that the child has another nationality, you may contact the country's embassy or consulate directly to inquire about denial of that country's passport. The addresses and telephone numbers for the foreign embassy or consulate near you are found on the Consular Affairs Internet web page at http://www.travel.state.gov under Foreign Entry Requirements.

Passport records:
Parents interested in obtaining passport records of their child(ren) may submit a NOTARIZED letter to the Department of State, Research and Liaison Section, 1111 19th Street, NW, Suite 500, Washington, D.C. 20524-1705. The request must contain the full name, date and place of birth of the child(ren), address and telephone number for the requesting parent, as well as your reason for needing the information. If you are requesting a copy of the issued passport application, there is no fee. If an authenticated copy of the passport application is requested the fee is $30.00 for the first copy and $20.00 for each additional copy. The telephone number for information is 202-955-0447. The Research and Liaison Section does not accept fax requests. Please note that passport records requested from this office can take anywhere from 4-8 weeks to be completed.

If she has obtained U.S. passports without your knowledge or consent (required for minor children) she is in vio;ation of federal law. If you report this to the Department of State, those travel documents can be revoked. If they are revoked and she tries to run for Argentina they may be stoped at the airport.

The Argentine Emabssy and consulates will not get involved in U.S. domestic matters but on the intervention request from the State Department. The State Dpeartment can ask the Argentine authorities to not issue or revoke if issued, any travle documents for your children.

unfortunally ,your wife has the rights to claim the children citizenship of Argentina ,for both countries allow dual citizenship .......as far as her getting the US passports for the children without your permission ? one good thing about the children having the US passports is on your side .......that was her first mistake ..in favor for you of course ,
you may want to check with Argentina gov.to see if indeed the children have the Argentina ,passports ? not sure they have to answer you ?
