Handover passport form company?

First thing you must note that Indian Passport is the property of government of India & any theft, loss or misplacement should be informed to the passport authorities in India & with the Indian consulate in any foreign country. Now if this company has got your son's passport & they are not returning it, then make a formal criminal complaint/FIR against the company with the local police & the Regional Passport office from where this passport was issued & attach the copy of this FIR with it. It will be the responsibility of these government authorities both local police & regional passport authorities to further proceed against this company for the recovery of this passport. As far the terms & conditions of employment are concerned, it is upto this company to proceed against your son for not fulfilling those terms & conditions through proper legal proceedings by claiming damages etc but in no case they can withhold his passport which actually is the property of the government of India in this case issued to your son for his traveling purpose to any foreign country with their due permission.

The company has no right to retain the passport. First a registered letter be sent to the company seeking the passport. If the company fails to return the passport you can even lodge a compliant. For a FAQ on passport see the link below

Your son left for Dubai on an work assignment through some company in India. Now he has come back to India.Is it right ?

Dubai (UAE) employers usually keep the passports of their employees with them. An identity card is issued..
If your son has returned to India, he should have been travelling with his passport. Then why should he hand over the passport to the company in India. He does not need to.

No body has any right to cancel a visa or a passport
other than those who had issued the visa and/or the passport.
A visa can be cancelled or withdrawn
.Passport is being issued by Govt of India.
No body has any right to withhold it . It must be returned
to the party concerned.

You can lodge a complaint with the police
or send a lawyer's notice to the company concerned
informing them that you would go legally for damages...

usually it is against the law, but he must read in his contract whether it is mentioned or not to withhold the passport or not,
these cases happen many a time, has he finished his contract?
too many people get jobs and once there, they want to stop it, yet the company has paid for the visa and trip; not sure what you can do? unless he finishes his job;

My school, Queen International, school in Dubai took my passport and do not want to give it back, everytime i ask they give me the run-around. The principal of the school Ms Malak is also the Owner of the school, which is illegal. It is illegal to keep my passport and for the principal to be the owner at the same time. Pls. advise in my case. I got a offer from a company which I had accepted in writing. Company was to send me abroad immediately after joining so took my passport for visa purpose. Later 2 days prior to joining date I regret for not joining. Now the company is intentionally making me run around for giving me back the passport. How strong is my case?
