If you are looking at marrying someone just to get them to America for citizenship forget it. they will find out for the most part and you can spend time in prison.

Now if you do have a girl you love and she is overseas and not a US citizen then this is what you do...

First off you have to have proof that there IS a relationship. So keep all records of the two of you. Photos of both of you together, Plane tickets and your Passport showing your having met her. Keep all letters and other corespondance. all of this and more will be asked for by the government when you apply for a K-1 VISA. Also known as the Fiancee VISA.

Once all the appropriate paperwork is done you will recieve word of approval/denial from the Department of Homeland Security (Immigration and Naturalization division).

If approved they will forward your case to the VISA section of the US Department of State.

If approved they will forward your case off to the appropriate Overseas Embassy (Depending on your Fiancee's location)

You will then get a package from the Embassy detailing all the forms necessary that you and your Fiancee need to gather and submit to the Embassy. Your work and finacial history. (A Letter from your Boss and your last Filed IRS W-2 form). Her family and military or criminal background checks from her local government. She will also have to have a Medical physical to check for among other things, AIDS. There will be a list of approved Hospitals and Doctors she can go to for this physical.

Once all the forms are gathered together you will then submit the whole package back to the US Overseas Embassy that is handling your case.

After they have reviewed your case again, You and your Fiancee will be informed and a date will be schedualed for her interview at the Embassy. This is her interview but unless you have LOTS and LOTS of proof of your relationship, it is best for you to be there as well so they can interview you both.

After the interview you will be informed of your status and if approved the K-1 Fiancee VISA will be issued to her.

After she has entered the US on the VISA it is good for 90 days and you both must marry within that time or she must leave the country.

After marriage you must submit proof of marriage and all paperwork again for her to change her status and remain past 90 days as a legal resident Alien (Green Card). after about 3 years she is then elligible for Citizenship.

I am right now in the final stages. We are waiting to get our Interview date from the US Embassy in Bangkok, Thailand for my Fiancee. I will be flying back over sometime in the next three weeks most likely.
I met my Fiancee through family friends here in the States and I started writing to her overseas. When my friends took a trip back home to Cambodia they took me with them and She and I met in real life. We got engaged and have been in the process to get her over here to the US since last January.

~*~ You need to file an application for a K1 (fiance) visa. Then when everything is approved they will give her a temp visa for 90 days so that you can marry. Then they will schedule you an appointment to come into the local immigration office. They will require you to bring proof that you have legally married your fiance. They will also require you to bring documents such as electricity/gas/phone bill/etc.. You will also need to bring in documents such as a joint checking account. Photographs of the two of you together from the past to the present is also helpful. My husband had to wait 3 1/2 yrs to have his fiance visa approved. Goodluck!!!

Marrying her is no longer enough.

If she is in the US illegally (like if she overstayed a tourist or student visa) she will probably still have to go to the US embassy in her country of origin and apply for a permanent resident visa.

Once here legally, she can apply for citizenship.

A good immigration lawyer will be worth the money. He or she can cut through much of the red tape.

Tony, you don't have to marry someone unless you love them and intend to make a life together. Marrying someone just to get her into the US isn't a great idea.
The first step in the process is to have her apply for an immigrant visa (green card) and talk to the immigration officers to find out exactly what is required.
Then figure out how she can meet these requirements. If she is admitted to the US as an immigrant she can work, and do anything else a citizen can do, except vote. But she can use her time studying to meet the citizenship exam requirements and by the time she has met the residential requirement, she will be ready to pass the test.
Marriage isn't something you do to get someone into the country, unless you truly love them and plan to make a life together.

Just don't forget that if you marry for money that's a federal no-no. Know what I mean? So if you're fiddling with the idea of marrying someone who will become a citizen simply by the marriage - remember - you're in love.
