How long can a U.S. citizen reside in Spain? Expert needed.?

I am aware that the normal limit is 90 days (during a 6 month period)

I am living in Mallorca with a Spanish citizen and helping him with the cinematography and editing of his movie (for free).

On May 14th, I would like to leave Mallorca, to go to Russia and then Asia (visit family / friend's wedding). By that time (the time I leave Spain), I would've lived in Mallorca for 73 days.

I will return to Mallorca in the last week of June. I would like to stay here for 5-8 more months, as that is how long I predict this movie will take to finish.

However, once you exceed the 90 day limit, you cannot return to Spain for 6 months. Naturally, I do not want to wait 6 months to return. How should I got about extending my stay?

Although I am doing my friend a favor by working for free (so far this is also a non-commercial film), he can employ me in his production company- if that is what it takes to get me a work visa (if that would extend my stay, for how long?). Should I go this route?

Is there any other way, I could just live here for about 6 more months?

Thank you in advance. I realize this is a complicated situation. Advice from someone with a somewhat similar experience would be really appreciated.

I apologize for the misunderstanding but I do not see a reason my friend (also a producer and owner of a Spanish production company) cannot employ me.

I am currently doing him a favor by helping him with a non-commercial project. However, he can employ me (paid) as a cinematographer, or editor, for one of his commercial projects and I would also be working in his production company on a commercial project, legally.

Please elaborate, if I have misunderstood something.

Your friend cannot employ you since he would need to get an approval to hire someone from outside the European Union area from the Spanish Government. This type of approval is only granted if your friend can prove that he was not able to fill the vacant job by personnel of the local Spanish and the European Union labor market; almost impossible with nowadays unemployment rate.

If you plan to leave on May 14th, and have stayed 73 days you have arrived in Spain on March 3rd. If you come back end of June you can only stay for another 17 days visa-waived. You would have to leave and cannot return before September 3rd. That's the day when the new 6 month visa-free period starts in which you may again stay for 90 days.

To stay in Spain you could apply for a residence-visa for non-lucrative purposes (Permiso de Residencia Inicial). This can be done from Spain for U.S. citizen. See the requirements on the website of a Spanish Consulate. .. http://www.consulate-spain-chicago.com/ ..

Foreign Consular Officers are usually more strict for visa issues than local community employees. An American friend of mine who stayed at my house in Germany as base for his several trips to other European countries wanted to stay for another 3 months. We went to the town-hall after he has stayed for 60 days and he just had to fill an application form and pay the fee of €50 to get a residence permit valid for another six month after I have filed a formal obligation stating that he resides at my home which has cost €25. He is however a retired Army Officer whose income does not require him to work.

I would advice that your friend should check with the town-hall of his city whether Spain has a similar system and you may get a Permiso de Residencia when he files a Carta de Invitacion.

Government of Spain issues the visa and makes the rules and requirements. You have to go to their counselate for special visa work permit. and of course, your US passport must be in order.

Going by what you have said, you can stretch the 73 day period abroad to extend beyond 90 days, this way you will not have resided in Spain for 90 days. Hence begining your 90-day cycle again. Hope I understood your question correctly.

I have a friend who lives in Spian and he's been there over a year. He has a job though, as a english tutor, so maybe that's why. As long as you have a passport and proper documents you should be fine. Why would they only let you stay three months? They love us in Spain.
