How long does the process take petition your alien wife from the Philippines to the States using the I-130?

Is it faster to do the K3 Visa?? I read on there that there's a clause where it's not only applicable to fiances.. but Spouses as well.. Is this route advisable and is there anyone out there that recommends the K3 Visa non-immigrant status?

I've been here in the Philippines on and off for 2+ years.. I have a newborn son and don't want to leave him for an extended period of time. I am an American Citizen. Born and Raised up until 30 till I came to the Philippines. I miss the states so please someone with any experience or expertise int the field please help. Also.. I have all the required documents NSO Certified.

1st thing, you can not petition for a K3 as a NSO Cenomar is now required and you've already stated you have all you NSO papers so your wife will not be able to get a "single" status on the Cenomar which gives you the only choice which is the K1. Have you reported birth abroad for your baby is a US Citizen? if not you need to do that and also get the baby a Philippine Passport so then you will only have to pay for your wife's visa. Here is the process and forms you'll need for the K1 Visa.
you will need the following forms:
-I-130
-G-325a one for each of you
-Passport pictures two of each of you
-Copy of Certified copy of Marriage certificate NSO
-Proof of your US Citizenship
-filling fee
After completing the above you will send your package to the USCIS Office that is listed for your state.

OK, After you have filed the above form and have received notice that it has been received then you need the following forms:

-I-129F
-G-325a one for each of you
-I-134
-Passport Pictures two of each of you
-Proof of your US Citizenship
-Copy of Certified copy of Marriage certificate NSO

After completing the above these will be sent to this address:
U.S. Citizenship and Immigration Services
P.O. Box 7218, Chicago, IL. 60680-7218

Now, your bride needs to get busy as she will need the following BEFORE her interview to the US Embassy
-NSO Birth record
-NSO Marriage Certificate
-Philippine Passport
-CFO Certificate
-NBI Clearance
-Police clearances from ever place she has lived

Generally speaking:

K-3 Visa:

- Generally processed faster than IR/CR visa
- General processing time span (8 - 12 mos.)
- Is a multiple-entry visa, meaning:
+ You can come and go from the U.S. after entry w/o advanced parole
- Requires that you adjust status after entering the U.S.
- Requires application for EAD & SSN in order to work in the U.S.
- Begin by filing I-130 following by I-129f

IR/CR Visa:

- Processing generally longer than K3
- Gen. processing time span: (10 - 14 mos.)
- You arrive in the U.S. as a Legal Permanent Resident:
+ No need to adjust status after entering U.S.
+ No need to apply for work permit. It's already granted.
+ However, to work you'll need SSN and drivers license

**If you have resided in the Philippines for a particular period of time, you may petition for the IR visa while in that country.

Typically, you can receive the IR visa MUCH sooner in such a case.

If you are married, then you cannot apply for a Fiancee visa, as was suggested.

You can only file I-130 and, optionally, I-129F, for a K-3 visa. It is NOT required to file for K-3 if you filed I-130.

Usually, it is better to follow the I-130 route as it will ensure that your wife enters the USA as a permanent resident (could be conditional, if you were married less than 2 years). This means that she will get her green card and you will not have to deal with the USCIS upon your arrival in the USA.

As compared to K-3, which is a NON-immigrant temporary visa. If she comes to US as K3, she will still need to apply for her green card.

As to how long it takes, I do not see big difference in processing of Immigrant visa or K-3 visa.

The fastest way for an American to bring a woman from the Philippines is through the fiancee visa.
Part of how long it will take depends upon you; are all of your forms filled out completely and accurately and legibly? Do you have all your supporting documentation (birth certificates, marriage contract, Affidavit of Support, passports...passports and birth certificates for yourself, your wife, each child.
You need to show where you will be living in the U.S.; it is really necessary for you to have a job stateside (or business, retirement, etc.) and the more money in the bank, stock, etc., the better.
You will need to check with the U.S. Embassy on Roxas Blvd. in Manila (or Cebu, whereever).
I married a Filipina while I was in the Army; yours should be a piece of cake (don't need permission from the company commander, etc.)

It takes a long time regardless. It was almost 10 months for my wife's fiancee visa to be approved. We had to show pictures of us together, letters to show we had an established relationship, etc. Even then I had to go over there and raise hell at the embassy to get her seen. this was back in '91, things are probably a lot tighter now.

It might not hurt to get your congressman involved.

They need to streamline the fiancee/wife process from the Philippines. It's a foregone conclusion that any single guy who goes there is going to come back with a wife.
