Hi,
I completed and sent the I-130 form for my mom. Now, that it's summer she would like to apply for a visiting visa like every summer! Can she still apply for the Visa while her I-130 is in process??

she can certainly apply, however the pending I-130 may complicate her ability to get a tourist visa. however, if she can convince the interviewing officer that she intends to return to do her immigrant visa at home, she can be issued. |

Sure, there's nothing statutory against it, but the threshold for issuing a visitor's visa is that the applicant is not an intending immigrant. That is in the law. I imagine it'd be kinda tough to convince a consular officer that you're mom is not an intending immigrant, given that you have filed immigration papers for her. My guess is you need to wait it out, until the I-130 is processed. |

Yes, she can apply for a B2 visa while the I-130 is in process. Like everyone else, she will have to satisfy all the requirements needed for the visa like proof she will return to her home country after the visit. |
