My boyfriend entered the us with a c-1 visa (crewmember). He's been here almost two years. We plan to get married soon. Is there a way for him to be legal in the us. What's the best thing I should do?

Since your boyfriend is now illegal he will have to return to his country of origin in order to become legal. You will have to file Form I-129 "Petition for Alien Fiance" which could take 6-9 months to be approved. This application is available at www.uscis.gov. Once the application has been approved and your boyfriend is given the visa you will have to marry within 90 days. |

since your boyfriend is illegally staying in the USA ........not sure you can now legalize his stay .....:-(
there is no legal way for you two to get married since he broke the law ..........i wish i could tell you .but unfortunately he is not in the country by rights ...
i have looked but no luck , the only thing that comes to mind : is to hire an immigration attorney in your area to see , if you could get some legal advice , but ? not sure if it will help ?

Why are you marrying someone who has no respect for US laws? Get him legal first (he will probably have to leave and re-enter).
Also, be aware that he could take the kids and go back to his country, and it might be very difficult to get the kids back (again - someone who overstays by 2 f-ing years shldn't give you a warm-and-fuzzy feeling re trust or stability).
FYI: simply marrying him WON'T "make him legal." It will just make YOU married to "someone-who-is-deportable." |
