I have heard lots of confusing info on this, is it true I need his fathers permission to travel abroad as I have an Italian passport?
Also my son was born here in Britain, and yet he can not apply for a british passport even though he was born here? his dad is british but we were never married and are not together now?

I believe Lucinda is correct. I'm not sure about the parental permission though. Legally you may require his father's permission to take him out of the country. As a practical matter you probably don't. But be sure you have something that shows it just in case -- if for no reason than to make it possible for him to travel elsewhere in the future. Many countries will not allow a child to leave or enter without an explicit parental permission from both parents or a court order showing that one parent has custody.
And yes, if his father is a British citizen and he was born in Britain (or not, really) he is a British citizen. Is his father's name on the birth certificate? if so you only need to prove his father is British to establish his right to a British passport, but he will need permission from both of you to get one. |

nowadays,children are not allowed to travel on the parent's passport,
if you go back to the UK? your child will not be able to enter trough customs,he needs his own passport,many parents who still have the children on their passport,are turned back.

1. You don't need permission if he's on your passport unless there is a court order that says you must have permission form him or the court e.g. given as part of a contact or residency order when you were working out custody. If there's nothing like that, he only needs one parent's permission to travel.
2. If you applied for a British passport, you would probably succeed as he was born here, lives here AND one of his parents is British. He seems to have more of a claim to British nationality than Italian.
It doesn't matter that you never married and aren't together now as long as his father has parental responsibility for him, which will be automatic if he's on your son's birth certificate. |
