For certain medical professionals i.e. Registered Nurse, you qualify under a schedule “A” waiver which allows you to receive your permanent residency through a worker petition I-140. However you still need a full time employment offer from your employer. The only item you will not need is the Labor certification, that’s makes things a lot easier. So in this case the petition would be I-140 skilled worker petition EB-3 special occupation schedule “A” waiver.

Yes. You do. I'm assuming you are in the US now on your H1B? If you have skills to work with this healthcare job and they hire you, you can file your paperwork at the US based office, there is no need to leave the country over. If they switch you in the system and you have current paperwork, most times you do not need to leave the country to reapplpy for the H1B. If you need schooling or something, you'll have to apply for another visa. I am not sure if you can do this in the US [I think you can, but am not positive.] I think the best thing for you to do is call your home country and speak to the Consular Dept. for NIV [non-immigrant visas.] They'll be happy to tell you and can give you all the info you need specific to your case. Just be sure to call during the hours they request, or you'll get on their bad side! |
