I was in the military in Spain - Can my son maintain dual citizenship?
Find answers to your legal question.

I was in the military in Spain - Can my son maintain dual citizenship?

My son was born at a us military hospital in Spain. I never identified his father. Can he claim Spanish citizenship? He's been living in the US and has not yet turned 17. Is there some kind of time line for such a declaration?

Sorry, the hospital is on US Soil and you are American. Unless you can PROVE his father was Spanish then there is no way he can claim dual citizenship. Is there a reason you need to know now...? IS his father Spanish and can you declare it with the father's agreement? If so, it doesn't matter the age of your son.

Highly doubtful. The military hospital is on US soil; it just happens to be in Spain. Unless his father is Spanish, he's American.

He has no right to Spanish citizenship whatsoever. As part of the agreement for military bases, all children born to military personnel and their spouses are expressely barred from any claim to citizenship in that country. It's the same with military bases in Germany. It was the same when there were bases in Philippines, Panama, etc. Even NATO -- child takes citizenship of the parents and barred from any claim to citizenship in the country where the NATO personnel were based.

You never identified the father, and none is listed on the birth certificate. Even if the father were a citizen of Spain, he would have to prove the child is his and get his child citizenship, if it is possible after all this time.

Im pretty sure that if he was born on a US military base on foregin grounds, he is only a US citizen.

This is how most people go about dual citizenship.

If the parents are born in another country and the child is born in a different country then the parents or vice versa you can then let the child have dual citizenship.

The United States of America does not recognize dual citizenship. If he wan'ts to be a Spanish citizen, he can not be a US citizen.
