If one was indictment for tax evasion while out of the country, can he apply for passport renewal @US embassy?

Will he be arrested at the US consulate if there is no extradition treaty between the US and the country where he currently lives?

No, they won't arrest you at the consulate or embassy; contrary to popular belief a consulate or embassy is not US territory; and they would still have to transport you through the host country, at which point they would have to release you.

But they will not renew your passport.

He cannot renew his US passport if he is wanted in the US. He will have to find another country that will grant him citizenship, or return to the US to face the music.
