If you're born in a foreign country, in an U.S. embassy, are you American?
Find answers to your legal question.

If you're born in a foreign country, in an U.S. embassy, are you American?

Hypothetically speaking, if you are born on the grounds of a U.S. embassy in, lets say, China, would you be considered an American citizen because you were born on "American soil"? (this is assuming that both your parents are not citizens)

Neither American embassies nor military bases are considered US soil and giving birth in either location would have no effect whatever on citizenship. If the child was a US citizen, it would be because the mother and or father was an American. Personally, I wouldn't count on a consular officer or a US marine to deliver my child anyway.

No one gives birth within an embassy - except in the case of an emergency - and I've never heard of that happening.

American diplomats posted outside the U.S. either travel back to the U.S. to give birth or else have their children at a local hospital in their country of assignment.

If the parents are Americans, then the child is automatically a U.S. citizen. However, the parents need to get a Record of Birth Abroad for the baby from the U.S. Consulate in addition to the local birth certificate. Depending upon the country where he or she is born, the child may also have citizenship for that country and be a dual citizen.

Embassies are NOT "American soil." They are the sovereign territory of the host country, but they are subjected to special rights and protections under Article 22 et. seq. of the Vienna Convention on Consular Relations.

Yes, a US embassy is considered United States soil, owned by us and as such if born there you are a U.S. citizen.

Yes, same goes for military bases.

yes, anything that is considered american territory, or american soil as you put it, counts for citizenship if you are born there

Yes.

Yes. Embassies (and military bases) are legally sovereign United States soil. It would be no different from an illegal having a baby in the United States.

Although it's unlikely, since most embassies aren't equipped with the facilities to handle births.
