Immigration question?

My wife and i got married(i'm a us citizen) a month ago but we have no house or appartment to live in. She now lives in sandiego because she got accepted in a 2 year Respiratory therapy program(as international student F-1), while im renting a room in a mobile house in sanjose also currently attending college. Will this be a problen in getting her greencard? We want to tell INS about our situation during the interview but we are concern they might turn us down. So far we only have joint bank account and evidence we've dated for 4 years before we got married.Our marriage is legite but how else do we prove this? Any thoughts on this? advice?

Your wife's marrying you affects her student visa. You need to deal with this urgently. Her visa could be revoked. Any visa violations or overstays and she could have to return home and be barred from reentry. You should have gotten your ducks in a row before you married!

To get her a spousal visa, you have to prove you have sufficient income and assets to support her and guarantee a $30,000 bond. As a student, you don't qualify for this affidavit of support. Without it, you cannot sponsor her for the spousal visa.

One problem is that your wife is on a student visa and she will have difficulties adjusting status.

The other problem is that although it will be easy to convince the immigration officer that your marriage is legit, you will fail to provide a sufficient income so that you could sponsor your wife. The affidavit of support that you have to fill out and prove with tax returns is a necessity for the green card application. If you have no income, you need to find a co-sponsor (U.S. citizen or permanent resident = green card holder) to have your wife sponsored. If you can't find such a co-sponsor, your wife's green card application will be denied because the U.S. government wants to make sure no immigrant becomes a public charge. If your parents can sponsor her on your behalf, that's perfect but like I said you should contact USCIS to see what possibilities your wife has to adjust status. It won't be easy because people are not allowed to get married on visas other than the fiancÃ© visa. You should have known that.

Do a search for K1 and K3 visa categories on line. Which one you apply for is determined if you got married inside or outside the USA. You are best to get a professional consultant to handle this for you ut you can file it yourself if you want.
