Hi. I'm a doctor who's finished my Pediatric residency on a J1 visa. I'm currently in between jobs and will be applying for my J1 waiver in a few weeks. I, with my 3 year old son (who has an American passport) are currently out of the USA but would like to come to the USA to be with my husband (whose got a green card and is a doctor too) until the waiver comes through. Can I apply for a B1/B2 visa and stay with him in America until the waiver is approved? Once approved, would I need to exit the USA and re-enter? I plan to obtain my visit visa from London. They were the ones that stamped my initial J1 visas. Thanks for all your help!! :)

An interesting question. Can you apply for a visa? certainly. given that your intention is to remain in the US indefinitely though, they would turn it down. the immigrant petition will complicate things, but tell the truth about it as the penalty for being caught trying to hide it can be severe. If you do get the visa, you may still have problems getting into the US at the airport. Are you applying for a waiver based on an F2a petition filed by your husband? Hopefully, he filed some time ago, as those petitions take 5 years to become valid for use from the time they've were filed. If you're applying for an H1b petition, then you would be able to use it once it was approved, although if it was filed this year, you wouldn't be able to work on it before October. |
