My father was born in 1946 abroad in the US Army at the 130th STA. Hospital, APO 403. The report of birth was made out at American Consulate in Stuggart, Germany on Marc 25, 1948. Info was furnished by father and supported by physicians certificate. His mother traveled to USA on a temporary travel document (in lieu of a passport) on the General Sultan to Port of New York in October of 1948. He tried to locate his fathers military records but was told by the National Personnel Records Center that all records from Army Veterans discharged between 1912 and 1959 were destroyed in a fire. My father has never had a certified copy of his birth certificate -- he used the the regular copy of it to obtain his drivers license and to register for the draft after he turned 18. He then recieved his SSN and has used it a number of times crossing the US- Canada border without problems. My father has paid into Social Security since 1963 and will be 62 next month. The Social Security and Homeland Security (didnt want to listen to his story or look at all the proof he has) they told him he has 60 days to prove that he is a naturalized citizen or is lawfully present in the U.S. or they will withhold his benefits. Any suggestions?

Go direct to your local Congressman's office (do not call and do not email). Go in person, every Congressman has at least 1 local office in his/her district. A case worker will be happy to resolve this for you. Take all the paperwork he has, everything.
You don't need a lawyer at this time. |

I would recommend posting this in maybe the either the immigration section, military section, or government section, you might get your answer there. I would hire a lawyer. |
