It doesn't matter if she marries a British citizen, her husband can be with her in India. She was deported, which means she is normally banned for up to 10 years, and has very little chance after that of getting a new visa.
Here is her possible ban
* One year if, she left the UK voluntarily at her own expense;
* Five years if, she left the UK voluntarily at public expense; and
* Ten years if she were removed or deported from the UK following their breach.
So if she was actually deported, then she is banned for 10 years
Why do people think they can break the law and be deported using taxpayer money, then expect to commit marriage fraud just be able to come back? You don't think she is going to be suspected of marrying just for a visa due to her past overstay? Considering the new government announced a huge reduction in immigrant visas for non-EU citizens, she doesn't really stand any chance.
She had a chance and screwed it up by overstaying, so she has nobody to blame but herself. All she had to do was follow the law and either apply to extend her visa, or if that wasn't possible, to return home and apply for a new visa. |
