My girlfriend is here on an out of status j-1 visa. Is there a way I can become engaged to her?

What I was looking for was a way to become engaged and allow her to stay here. She is not on the two year restriction. I spoke to a lawyer and I know I can marry her but I am not sure I am ready. I know the k-1 visa is an option but that seems like a lot of paperwork if I am then going to marry her soon anyways. My fear is she gets deported. She is out of status because she quit her Au-pair nanny job with no notice. Her actual visa is not expired.

Becoming engaged will have no bearing on the situation, but she does have a 30-day grace period to allow for travelling. In the meantime, she will need to either leave or get a new visa status (which may not be possible, since the J-1 is supposed to be for cultural exchange). It's possible (I don't know about the relevant law) that if she found employment as an au pair somewhere else she could be in status again, if that's the case you or someone else could bend the truth a bit about hiring her an as au pair.

However, I really do recommend having her get a new visa, even if it means leaving the country for a while. It's nice and legal, and having shadiness on her record may prevent her from receiving citizenship later.
