My husband and I have been married for three years and have a two-year-old daughter. We would like to take a trip to the States this summer to visit my family and friends. He has recently been denied a tourist visa and we have no current or future plans to move to the States. What are my other options? Falsely apply for an immigrant visa? The problem is they don`t even tell you why he`s been denied so you have no idea what has to change for him to receive one in the future.

Well, they are supposed to tell you something, even it is frequently in a form letter stating you were turned down under Section 214b, which is by far the most common section used in tourist visa applications. That basically means that the applicant was unable to convince the interviewing officer that he has such strong economic and social ties to his country that he will return and is not an intending immigrant. Considering that he has an American wife and child, it's not too hard to imagine that the officer was concerned that he might not return. It's not like consular officers don't see people trying to do exactly that every day. Plus, even if your husband did get the visa, the immigration officer at the airport would also be concerned about his intentions.
You could go with him, if you like and explain whatever your reasons are for wanting to remain in Peru. He would have to pay again, of course, and there's certainly no guarantee he'd get a different decision. You could file an immigrant visa petition for him in Peru, if you're a legal resident there. That would be far faster than anything you could do in the US, in reality. Of course, if it isn't your intention to move to the US, it's a lot of time and money just to go see Disneyworld. |

The requirements for immigration are even stricter than those for a tourist visa. Why not call the embassy and ask why it was denied? |

It may sounds funny, but many friends told me that when applying for a US visa, if it will be granted or not depends on the mood of the person who gives the Visa. So, I would advice just to keep on trying. |

First thing to consider is that, whether your husband had provided all the required documents or not?
For a visit visa, an invitation letter from the family or friends you are going to visit, is very necessary. So is some proof of your return; like a nice job, or some kind of bond which shall bring you back from US. |
