I had immigrant petition by my mother as a single, but for about 15yrs waiting I got married now for 9 years, do I still have chance to approved my immigrant petition?

That would depend on whether your mother is now an American citizen, and if she is, exactly when she became a citizen. if she isn't an American, then your petition is invalid. If she is an American but became a citizen after your marriage, then again, your petition is invalid. If she is a citizen, and became a citizen before you married, then the petition is still valid, but it will have changed to the F-3 immigrant category and the priority date will have changed as well. However, if the petition is still valid, it would also cover your wife and any children you may have. |

No. You and your husband would have to apply from your home country as a separate application. You would have to meet all of the requirements for immigration.
If your mother is a US citizen now and if she is willing and able to sponsor you, having a relative sponsor you will shorten your waiting period, if you meet all requirements for immigration. Your mother would need to earn enough to support not only herself and her family, but you and your husband (and any children you might have) as well in order to sponsor you.
If your mother does not have citizenship, but is only a legal permanent resident, she cannot sponsor you. |
