The first answer is largely nonsense. if she was accepted at a school, she could apply to change to F1 status in the US while here in F2 status. If she was in status as an F2 or an F1 and was qualified for the H1b visa category, again she could apply through USCIS and change status, once she had an approved petition. If she left the US after changing status, she'd have to get a new visa in the proper category to return. Check out uscis.gov for more information on changing status while in the US. |

If your wife wants to go to school, she must apply for her own student visa from her home country. She will have to prove she has sufficient funds for all of her educational expenses and living expenses. Student visas are issued on the condition that the student return home upon completion/termination of studies. As for an H1-b, an applicant must have a minimum of 2 years experience beyond the baccalaureate degree.
You also need to consider that it is becoming more difficult for companies to prove that there are no citizens qualified and available for the job when over 450,000 citizens per week are being laid off. Many companies are not renewing employment visas, or are outright terminating the employee before the visa expires. In either case, the employee must immediately return with all dependents to their own country at their own expense. This is not a good time to be looking for jobs in the US. |
