Pardon or Waiver Appt for immigration?

My husband is currently living out of US due to his Visa and since he has 2 children born in US and I am American Citizen he is eligible for a pardon and we have a waiver ready but cannot get an appt. Its all done online and we look every day and there are none available. Has anyone been in this same situation and know how long it takes or how to obtain an appointment? I do have an attorney and he is helping as well but I am desperate to get him home as my children are very upset and do not understand the situation. Jsut looking for ideas or helpful info on obtaining an appt.

He is applying for a waiver on the grounds of admissibility because he is married to an american citzen and has two children in the US.

It might help if you separated the two words, pardon and waiver, in explaining your situation. They are not synonyms.

A waiver is the act of intentionally relinquishing or abandoning a known right, claim, or privilege. In the immigration sense, it could be considered forgiveness. If a person is inadmissible or not eligible to receive a visa, he can apply for a waiver of the grounds of inadmissibility. If the waiver is granted, then he can get the visa.

A pardon is forgiveness for a criminal offense. The U.S. does not recognize foreign pardons. So, if you're working on a foreign pardon, you're wasting your time. If you're working on a waiver, keep working on it. Which one are you working on?

I'm sure that your attorney is well qualified and would be happy to get your name on an appointment list at a U.S. consulate.

You didn't say which country your spouse is living in. Some embassies have an on-line visa appointment service.Some allow you to make an appointment over the phone. Have your credit card handy.

could you explain what sort of waiver or pardon he needs? what has he done to have to ask for a waiver or a pardon?

My wife is in south africa for 6 months knw,She left when her visa was 4 months expired. Ive applied too get her back but its taking so long.Know she has too wait an extra 6months,can i get a waiver or a pardon too get her back soon.
