I'm a USA citizen and my finance lives in India. We would like to get married here and have him able to work here after our marriage. I've been reading through the US Immigration website and am very confused. I see that we start with a K1 visa to get him here. When we get married, what kind of options for employment does he have regarding his legal status? Will he get a green card from our marriage? I know there's a process to go through and forms to fill out, but he will want to start a job here in the USA asap and I'm just confused about what his status will be after we get married and will he automatically be able to get a job and become a USA citizen eventually? What will his status be from right after our marriage to the end result of becoming a USA citizen? Thank you.

First, you must have met him in person, face to face, in India within the last 2 years. That's required.
You file the following forms.... I-129F, I-864 and G-325A with the USCIS. Be sure to include the required evidence of your relationship as described in the instructions.
In about 8 to 12 months your fiance will receive a package of information from the US embassy, or a US consulate, in India. He'll get a physical exam at a clinic authorized by the embassy or consulate. He'll fill out a series of forms and return everything to the embassy or consulate.
When ready, he'll be notified to make an appointment for a personal interview. If approved, he'll receive his K-1 visa.
After arriving in the United States you have 90 days during which to get married. After the marriage he will file I-485, I-131, and I-765.
He'll get his work permit in about 90 days. After getting it he can take any job that's offered. He'll get his conditional green card in less than a year.

Yak is right and follow his link. Just don't get your hopes up that whatever he is doing back in India will be the same work he will be allowed to do here. Foreign credentials are seldom given the same weight as North American education credentials. And yes, the end result will be your husband becoming a US citizen.** |
