I have a question, i was in the UK before, and had no criminal record except a few months before i moved here to the US. I was fined 35pounds for urinating in public. I got a 3 month conditional discharge/ caution, and it was spent after 3months. I'm now applying for a holiday to visit UK, and on the form it questions if i have a criminal conviction. Am i required to give details of this conviction even though its spent? is a conditional discharge/ caution a criminal conviction? will it still be on my criminal record? your advice will be greatly appreciated.

It is not spent. You received a conditional discharge/caution AND a fine. While the order for the CD may have been spent after only 3 months, the fine is not spent until after five years (2.5 if you were under 18 at the time of the conviction).
You would be mad not to disclose it unless it is spent as it will be on the records. You are not required to disclose it if it is spent. It's not a serious offence and is unlikely to prevent you from getting a visa to visit.

You did not mention your nationality and current passport you hold, so it is difficult to answer your question, however, in general the answer is :-
If you have given any kind of finger-prints (bio-metric system), while you have convicted in the U.K. and your nationality demands (some countries are required to give compulsorily electronic finger-prints upon submission of an application).
Then you should mention your previous penalty history in the UK application form. Because it is easy to trace, within the record of Bio-Metric system.
If not, you can avoid mentioning in the visa application form. Its upon you whether you mention or not. |
