I've worked for a company in Jebel Ali Free Zone for more than three years. But because of conflicts with my Manager, I decided to resigned. I gave one month notice and they accepted it. During then, I started to look for a new job. Luckily, after they released me (Jan.15), I got an opportunity from a company which is now ready to process my visa and fix everything so I need not to go home. My problem now is my former company doesnt want to give my passport. They're saying that its a company policy that anyone who resigned/ terminated will be bring back to home country. They will only give it in the Airport prior to my scheduled departure. Is that valid? Do I really need to go back home though this new company is now willing to process my visa. Please advise for they booked me a flight on the 25 of Jan. Awaiting for your soonest response.

This is not a decision the company can make. Only the government can make that decision. They can no more keep your passport than they could keep your birth certificate or your credit card. In fact to hold anothers passport is often a crime where not mandated by law. Go to the police. |

Exactly! Call your Embassy! The company is NOT a Police Force, and has NO right to keep your passport! What a nerve! They do not hold the key to your liberty! |

Your passport belongs to your country, not your boss. It should never have been taken by yourcompany as collateral. Go to your embassy or consolate and get them to help you get it. |

I have no idea if its legal or not. I suppose its a matter of what country you're in, what your employment contract said about it, and why your employer has your passport in the first place.
However, why not just go to the airport, pick up your passport, and then walk back out of the airport with your passport? They can't force you to board the plane. |

Their policy is usual in a lot of countries. You first go back, than you ask for a new Visa and work-permit. Have a nice flight. |
