I'm a peruvian citizen and i'm currently living in Peru. I once was living in New York on a student visa. I met my boyfriend through internet so we dont have pics together to help me be eligible for a fiancee visa. I was recently denied a tourist visa to the USA so my boyfriend has decided to come over to marry me and get the problem solved. He's currently on probation right now but when's he's done with it he will come to get married.
The problem is i dont know if we should because i understand that it's easier to get a fiancee visa instead. I figured for him to come for a lil while take pics together and then he can go back and file for my fiancee visa. What's the best process? Also, he's considering staying in Peru for more than six months, perhaps a year. He wants to make sure he's able to take me with him when he goes back.
In other words he will be residing here which will make me uneligible for a fiancee visa. Is there any other kind of visa or any other process to follow?

it all spells fraud to me keep in mind that your B/F can be arrested and charged for fraud beside all that before you are granted any sort of visa you B/F has to meet certain financial prerequisites so you don't end up on our welfare roll fiance visa will not be granted if he lives there and both of you depart at same time DHS will hold you at entry port nd turn you round home bound |

If your boyfriend is willing to come to Peru, marry you and live with you for over six months, he can file the I-130 petition for you to immigrate to the U.S. in Peru. Petitions filed directly at the embassy will be processed faster than those filed with US CIS in the U.S. The key is he has to be legally resident in Peru for six months or longer before he can file. Easy. Don't marry him. It is not worth marrying a convict to become a citizen. You met someone online, he is on probation, sounds like disaster waiting to happen. Believe me, whatever he said he's on probation for (I know, I know, he's "innocent"), the real reason is probably 10 times worse!
