What do I need to do for my spouse to get a resident card?

My Husband was brought here to the U.S. from Mexico when he was five. Now being 21 he wants to get his papers so he can stay here legally with me and our 3 yr old son. We have been together for 5 yrs and married for almost 2 yrs. So what do we have to do so he can get his resident card? Thanks

I would check the Mexican Embassy. I would make sure the enquiring person is legal. If there is no Embassy around, I would go check with the closest customs office, which is at every major airport and the border. Just say "I know someone who needs to become nationalized what do I need to do?" Don't give any names

Since he entered illegally, he can't adjust to immigrant status while in the US. If he had come in on a visa, that would be a different story, but he didn't. So, you'll have to file an immigrant visa petition for him, but once it's processed, he'll have to go back home and do an immigrant visa interview. Since he's been living here illegally for over a year, he's currently ineligible for a visa, but he will be able to apply for a waiver. If that's granted, he'll be able to return legally. However, he won't be able to come back until he does have the waiver and the visa. Check out uscis.gov for the I-130 immigrant visa form and instructions.
