What is process for American w/ Thai wife to obtain passport for child and how long does it take?

We live in Thailand now and will be travelling to the U.S. to have the baby next year. My wife has a ten year tourist visa and can only be in the country 90 days. If she has the baby, can she file for an extension on her visa while she is waiting for the passport on our child?

As long as your home is in Thailand, you and your wife can visit the US to have your baby using her tourist visa. Why do you believe that she can she only stay in the US for 90 days? CBP allows up to 6 months routinely. In answer to your question, of course you can request an extension of her stay if you have to - just make sure to apply well before the date on her I-94 card runs out.
It shouldn't take more than a month to get the baby's passport - depending on the time of year, of course - if you're prepared in advance with all the documents you will need.

ok I got this.
You must apply for the I-130 visa. that is the petition for an alien relative.
This process usually takes 6-10 months.
However if you keep in contact with the USCIS.COM, it wont hurt and may make it shorter. |
