Im asian and the father of my child is American,he still not divorce so, he cant get me fiancee visa.What should be the best thing we do?

Since he is married, he cannot get you a visa to the US. Since your child was fathered by this guy, if you try to get a tourist visa, there is a presumption of immigration fraud -- that you intend to remain in the US with your boyfriend. This violates regulations concerning tourist visas.
As for your child, you are not married to the child's father. The father has to go in person to the nearest US consulate and file for "birth of a child to a US citizen while abroad." He needs proof of US citizenship, the child's birth certificate with parents' names and citizenships listed, the hospital records, the child, passport photos, etc. Since you are not married, and apparently he didn't do this immediately upon the child's birth, DNA tests are likely to be required.
You are not coming to the US unless he gets a divorce and then files for a fiancee or spousal visa for you. He needs proof of the divorce being final before he can file an application. After filing, it will take a year or two before you get the visa, if it is approved. |

Did you register the birth of your child to the US Embassy in your country so that your child will have US citizenship? If not, try to do this first. You will need the help of the father.
If not then the best is just getting a tourist visa.** |
