I went to US as a H4 holder dependent on my husband who is on H1.My husband filed for H1 to me last year through a consultancy in USA and i got my H1 approval notice.Now due to some clashes we both got separated and he left me in India at my native.Now i wish to go back to US and work there using my H1.Is there anyway that my husband has the chance of canceling my visa?Or what should be done inorder to retain my H1 visa?
Kindly help me regarding this...Thanks in Advance..
Befor processing of my H1 he paid some amount to the consultant...

This is no problem (assuming your H1 is still valid and that you had a legitimate employer, not a fake "consultancy" position). Your H1 is based on your employer, not your husband. Just contact your employer, and have them fax you a copy of your petition. Make an appointment at your local consulate, pay the $131, and present your petition. Everything should be fine. Also, if you're separated, but not yet divorced, you can still use a copy of your legal husband's petition to travel as an H4, but only if you have someone to stay with while you get your H1 back in order, because obviously you can't work on an h4, and you don't want to jeopardize your status). Anyway, sorry about your husband, and good luck getting back to the US.
