This is no problem (assuming your H1 is still valid and that you had a legitimate employer, not a fake "consultancy" position). Your H1 is based on your employer, not your husband. Just contact your employer, and have them fax you a copy of your petition. Make an appointment at your local consulate, pay the $131, and present your petition. Everything should be fine. Also, if you're separated, but not yet divorced, you can still use a copy of your legal husband's petition to travel as an H4, but only if you have someone to stay with while you get your H1 back in order, because obviously you can't work on an h4, and you don't want to jeopardize your status).
