The same laws that apply to every one in your state (gay marriage) and it doesn't matter who you're going to merry because the immigration status will come back later.

Which country are you in? If gay marriage is legal in your country, then you get married and sponsor your spouse in the same way as a hetero couple.

If gay marriage is not legal in your country, then you can't do anything
